Durham Tees Valley loses BMI compensation claim
01.05.09
Durham Tees Valley Airport is to appeal after losing a £12m damages claim in the High Court against BMI. The airport claimed BMI's budget arm, bmibaby, flouted an agreed contract when it withdrew its flights in 2006, costing it millions of pounds. But yesterday a judge ruled against the airport, saying the terms of the contract were too vague.
After losing the case, the airport is facing a legal bill that could top £1m, with BMI claiming its costs are £700,000. However, an airport spokesman said that it plans appeal. Hugh Lang, group director with Durham Tees Valley's parent company Peel Holdings, said he was confident an appeal would be successful.
He said: ‘Whilst this decision has not gone our way, the judge commented that he was sympathetic to our claim. We believe that this decision can be overturned through the Court of Appeal.’
